Status As Of 28th Mar 2009

While waiting for our OC, only maintenance work are being done and this is to ensure when we get our key later, we would not have a lot of issue to complain about. This is why, if you were to go to this condo, on-site, you can only see a handful of things are being carried out. Once the OC is out, beautification process will start coz by then, we all could move in already.
Anyway, i manage to go to the site recently and took these pictures. For those who did not manage to go and see for yourself, you can take these pictures and imagine yourself being there. Bear in mind that all these pictures are taken outside from the building on the road leading to the area. Enjoy!!!

I'm one of the owner. To be frank, i'm truly dissappointed with the progress: i was told by the developer that the place would be ready by Aug 2008 at the vy first place, the latest would be by chirstmas 2008 as he ensured that v can definitely celebrate our christmas in our own unit by then. All the promises turned out to be empty. Now, v still cant even get our OC even by Mac 2009. I think that's vy unfair to those who plan to move in by 2008 as they might need a place to move in by the time. The handing over has been delayed by more than 5 months n still, i doubt whether v can get our OC by April.
In addition, the building's colour n structure seem to be so much different with the one v saw in the show unit. The colour of the condo seems to be too dark and not outstanding at all. This really give us a very "down" feel as it's not attractive at all. U can see the difference when comparing with the colour of sea view tower. The roof top is another huge failure of the project. The structure of the roof is totally different with the show unit's model. n the hole in between the roof really sucks!!! One other thing that i feel vy dissapointed is the condo really lacks of greens (plants n flowers) as shown in the flyers n the model.
With this i'm hoping that the developer can do something on these n i will really like to see some improvements b4 moving in.

Right now, according to the developer, plants are not really abundant just yet on top of the roofs as no one is able to water the plant everyday as the lifts have yet to be operational. Thus, the beautification will only start once people start to move in. Same goes to the ground.

But fret not as once we move in, we can start to make it as green as possible, with everyone's help that is.

I'm totally agree with the 1st comment,the building's color is damn ugly and I've nerver seen something like. Is very much like a low-cost flat than a condominium.

Moreover the lighting are day light (white colour) not cold light (Yellow light). As i know that, most of the Condo are Yellow light.

If you think your are buying into a low cost looking 'flat', why dont you just sell off your unit and look for another one which have the same size, layout, low price per sq ft and location. I am planning to buy a unit of VistaBay - I believe it is a very modern design building and have a great low maintenance system to control overhead. I dont think one can have good feng shui if one keep on complaining about their new house even before they move it. I wonder the bunch of you guy whom have bought VistaBay understand the whole situation of the current economy and development situation in the country. I am from Pg, working in PJ, have bought a 'flat' in PJ, compared to VistaBay, mine does not have really good accessories compared, plywood doors, wavy wall finishing, cheap fixtures, and the price 460K for 1320sq ft. Minimal landscape, big pool - HIGH maintenance - 0.25 psf. 280 units - nobody but 1 complaint about no trees, later he regret about more trees and grass and high maintenance.
I believe a HOME is not a house. If you want to buy a house with MAX landscape and MIN home setting, then you are paying to much and have to pay to maintain the landscape. You should buy more of a HOME than the exterior part. Keep the overhead low.

If youre still now happy with your 'low cost', give me your unit and number, I will buy it from your low cost price X 3! Let me know fast - I buying within this two weeks, before the VP.

I think some of the people who have bought VistaBay is kind of kia su. Complaint about everything and cannot even read english, where can you get a low cost at the price of RM210K? If all you owner of VistaBay don't like about your unit, then sell off and dont stay. Move on!

I think this is probably just a place to voice out our dissatisfaction on the project, not a forum to quarel...
If u r happy with the progress, it's fine for u to commend. However, pls dun seize the right for the rest who are not satisfied with it. Just take it as an oppurtunity for the developer to improve. Maybe using this way, together we can actually have something that everybody wants n dreams for.
So, just cool down!

Hi Michael, what is VP means?

I am one of the owner - NG. Frankly speaking Chin & Me are quite impatient on the progress work. I hope when we obtain the key of the unit, the finishing work is in tip top.

I like the building design. As it looks outstanding, trendy and the most important thing, we will get a lot of natural day light.

Chin and me like the facilities of the Vista Bay which is just sufficient.

We hope to hear the news from the developer soon.

Its stand for Vacant Possession..... or on the other meaning...... the hand over or key to the owner......

Taken from online definition:
"VP is when the ownership is transferred from the sale of a property there will be no tenants living in the property, or leases giving someone else use of the property."

For me.......but correct me if i'm wrong, OC (Occupational Certificate) is equivalent to CF (Certificate of Fitness).

CF or CFO (Certificate of Fitness For Occupation) is issued by local government to certify the building is safe to be occupied with everything in place

I manage to obtain the upgrading choices/design supplied by the developer. Prices seems to be high especially on the carpentary work. Hope the developer would get more quotations to suite our budget.

I also one of the owner in vista bay.
I do not feel very happy with the building color (gray)and also the white lighting. I strong believe that these two thing getting our vista bay impression.
I really hope that the developer can made some modification. You know the "parato" effects- made only little change but bring us a significant effect. why not we changes it soon?

We can actually bring this up inside the comittee which we are going to form up later and we can discuss on whether we would need to change the color of the building or the lighting whichever is necessary.

Do u guys really think that v manage to get VP by this month? 10 more days to go.... from wat i see, the chances of getting our key is getting slimmer n slimmer,haih!!! too much delay in this project n this really has disappointed me so much... day by day n month by month waiting,it's so frustrating!!! Pls,for u guys who are getting impatient n frustrated like me,voice out n let the developer knows about it.

I think it's a wise thing to form up a commitee asap for the owners. v need some channels to voice out our dissatisfactions. i think v can actually meet up by end of this month if the developer still unable to hand over to us. I think it's enough for all those empty promises. V have to defend our right as the owner! Anyone who agree, pls comment...

I have one question here and you guys help.
According to the building plan, the top floor will be the roof top garden if I not mistaken.
But, currently I visit our vista bay web site, I didnt see any garden on the top floor. Hence, do need your help to guide me for finding it out.

Hi Vincent,

The rooftop garden is still as plan as far as i know but right now, the garden is not yet visible. This will fall under beautification process and it will be done once we get the OC.

Hi Max,

Well, i'm not quite sure about the design of the roof top as i havent seen it myself but we can always witness it ourselves as the work on it will begin when they get the OC and by then, we already have the keys. So basically we can actually look on how they progress right?

Seems to me, that the progress on the council side (fire department) is taking longer then expected. We might see that the VP push back probably to early May. This is only my guess as no one can give us a very accurate answer, not even the developer.

OMG... Early May???? It has been delayed so many times already! I'm really furious about dy.. the work is so inefficient. If there isn't any problem, i dun think it will take such a long time to get approval from fire department, unless wat they build is out of the fire safety specs.

Yesterday i went to looks for our vistabay again.. The light is still "white" and...... really don't know how to decirbe my mood now......
Hopesfully all the beautification process will done when we get the OC.

Hi Vincent,regards for your question, i also no ideal, wat i can see on wednesday night , the light still is normal light. and when come to thursday, more teruk, coz our developer shut off all the light. so kedekut...!!( i think developer worry that owner see the building and do complain.)

Sorry for the late reply. I was sick these last few days and i'm still recovering.

Anyway, regarding your discussion topic which was brought up by Vistabay Owner, steve, VINCENT TANG and max.

Vistabay Owner:
There is definately no issue with the fire safety spec on our condo but if seems that the inspection by the fire department is not really a very fast task to do as they normally will schedule 2 visits on a condo in regards of the safety which is the main concern in every building. If you would ask me what they do on the 1st trip as well as second one, i really don't have idea on this also.....kekeke......sorry.

Vincent Tang & steve:
Lighting wise i can't really give any opinion as different people might have different view and thus, it is important we discuss first before we make any changes and same goes for the colour of the building.
Once we get the keys (VP), meaning we are authorize to walk into the condo and inspect it as the same time but that's about all you can do. We can't really move in yet as it has yet varified to be safe in a formal way. Only when we get the CF, we can actually move in. Bear in mind one thing that before getting the CF, we actually CANNOT start any RENOVATION work just yet but only after that, we can basically do what ever we want. This explanation also applies to the developer side as no changes to the building structure can be done before getting the CF.

I am one of the owner on the 6th floor of VistaBay, Mike, I think it is better for you to close down this blog and limit it to owners of vistabay only. There seems to be too many people complaining ridiculous things. And some of them, I think, not even owners!
All this information is getting me sad and killing my interest in the building which I have learn to love.
Now, maybe I will sell it after all this complaint.

We as a ownerof vistabay, we do keep post our comment , it is because that we are really unstatisfied with the developer. As you know, when we wan to purchased a condo, we spend all our saving money. Then, after we purchased the condo and find out that the condo dsign that you have purchase is different with developer show unit model.
Firstly, i would like to know, what are your feeling as a owner,(unless you are one of the member of the develpor, if not i think you will same as our feeling.)

Secondly, i don't think so other developer so free that everyday can sit in office keep post the comment and do complain.

I send this message was not pin-ponting on anyone. It is because that we are really "care" for our condo.and want to let the developer know our situation on waititng to get VP and CF. In the fact and we also not sure when we can get the VP, (coz only 4 working days only to get the VP).

I'm happy that Michael are putting effort on getting reply comment to evry owner. but i do hopes Michael can help us to talk with the developer, let thy know our probelm.

All you guy talking about VP and CFO without even thinking what is the meaning and the legality behind it.
Take a look at your SPA and I think like mine, it says "36 months to complete...".
As to my SPA, they have till July 2009 to give me VP. So, I guess I have nothing to say to the developer when they can give me my keys!

I think the important points when v bought a house are:
1. When the developer manage to pass over the place to the buyer
2. The design of the place
3. Price+location
All these 3 had come across my mind when i 1st bought vistabay. For the 1st point, the developer had actually promised the delivery would be last year which was not true. I'd actually taken his words n i expected to move in b4 this Chinese New Year. Now, i'm actually in trouble as i'm having accomodation problem.
2ndly, the design of the condo as shown in the flyer n model in show house actually attracts me to buy the place especially the rooftop which looks modern. I reli thought i could have moved in with a nice rooftop garden ready. However, it turns out to be so different n unacceptable. This really disappoint me.
But, the nice things are the price is considered reasonable n the location is very strategic. If i'm given a chance, maybe i will choose a developer which has a good track record of delivering the place on time as promised or earlier. N i wouldn't be in such trouble now.

I think it is better to be slow than if the project got abandon. The last economic price fluctuation really got to everybody, even my sales of parts, I guess we are all lucky the developer did not abandon the project, then we will have more years to wait and a lot more money to lose.
Think before you write. Better to be late than sorry.

Like wat i say,it's really unfair for those who had planned to move in by the date as promised, they might have bought the place as the expected date of handing over meets their requirement. I totally dun agree with u saying that it's better to be slow rather than the project being abandoned. This is not a problem for a good and responsible developer at all. As we can see all the established developers always have their project complete in time or even earlier, unless u r not confindent with our developer.

I am also one of the buyer of the unit. As about my feeling on the progress... which I have mentioned earlier, I also wait until very impatient.

However, unforesee circumstances is beyond our control and yet in the S&P it is not over 36 months.

A few frens of mine who has buy house in Batu Kawan now all in terrible state as they project delay and nothing being done now. it has been like this for the past 6 months now and their proj still see cannot complete. there r so many proj out there that is abandon but this one consider ok liao since they manage to overcome the steel price issue mid of last year where the price shoot up rocket hi.....but i dun think u know that dun u and 4 ur info, this is the reason why many proj go chap lap lo.......from what i c, this developer is damn good liao.......compare to the last houses and condos i bot.

We should look at the bright side instead of making ourself in miserable.
Actually, the date provided by the developer is the expected date, not the real delivery date. We need to be patient eventhough you like it or not.

Hi Michael, last week i go to visit for our condo, something need you to advsied me.

1) why the developer built the play ground in the ground floor of the car park? because the air of the car park is smoke and the car is alwys hanging in and hanging out. (isn't it built for temporary??)may be they can built on the roof top, instead of built on the garden opposite the gym room.

2) the swiming pool design..why they didn't buit any "safety post" e.g : to prevent our kid fall down in the swiming pool when they palying in the garden. ( as the garden are very small.)

3) When we can get the VP?

Regarding your question:

1) The play ground was build there as it was the best place at the moment to house those things but the actual place for all these things are actually at their designated area like for example, the children's play instrument would be at the front part of the gym where you can see the grass is steadily growing and for exercise equipments,they will be housed at the rooftop court yard. This is as far as i know on this matter.

2) Safety post is not in the plan right now but we will need to discuss on this matter as to whether it is necessary to contruct this item or not.

3) For me, i still think it would be May, since tomolo will already be May......kekekeke. For now, i can't give you a direct answer as i was quite busy lately and thus, i did not manage to go to he developer's office to ask them on the progress. Will update you guys once i know anything but i do hope that anyone out there who has nay update would update us as well. Thanx in advance.

Hi, I am 1 of d owner fr 12th floor.

I do agree with Steve & Vincent & Max's comment. As i mentioned bf, we owner may form up a committee to raise up the problem to "Consumer Dept" on the issue of the failure of rooftop courtyard as promised by the developer. Actually i must let all of you owner know that regarding the topic of "Beautifucian Progress" should be done by developer & it should be finished bf the VP or OC. It you guy go to check with other developer like "HOBOUR PLACE'S Park View & Seaview or the condo near Raja Uda petrol station, all of the beuatifucian progress done by the developer as agree and as show in their sales flyer. I m not talking nonsense here. Just go to find out yourself.

The problem is now our developer not completed the project as what the promised especially rooftop garden. And i still remember while i going to purchase this condo, we ask developer whether this condo will fixing white or orange colour. The women inside the office very confidence to answer us: Sure, it would be orange colour because it look more nice and mostly only apartment or flat using white colour light...

I think most of the owner like me, b4 purchase this condo they are attracted by the condo's living space, rooftop garden modeling style and location. Why i not purchase of Park View or Seaview at Habour Place & another very beautiful condo near Raja Uda bcause two of the buiding near "Kubur" and another one near petrol station. Same like Dr. TC Wong (dun know is real doctor or "PALSU", why not go to find more expensive condo over RM300,000), i believe "Fong Shui". I decide to buy condo but not apartment, so i deside to buy Vista Bay. The name is quite nice.

I sincerely appreciate that Michael being delivered us a lot of information fr developer & information regarding to our condo. But i think Michael should family fr developer.

Actually how must we comment here also no point. The answer like Michael feedback to us also not usefull. That is the reason i not come into this site quite long time. Waste time.

Now, let us wait the OC pass. If the developer wouldn't complete their part then i hope we may act together to fight for our right.

Creating this blog and talking more sense into it does not mean i'm from the developer's side. You can double check later when you know me more. I'm purely a purchaser, just like you and nothing more. I like the space and the strategic location it has to offer and that are a few main reasons i'm buying it but i think that does not make me a developer i guess.

What i want to say here is that, since we already bought the place and we haven't even move into yet, why make all the conclusion already regarding whether the project has follow all the specifications or not. Why don't we see how it turns out to be when we get what is rightfully ours and then we can decide whether we have been con or otherwise.

Believe me when i say that i want the things i bought come to be what i have expected but if there is some changes need to be made due to some reasons which are reasonable, then it should be considered as well.

Another 1.5 month to go before we celebrate the delay of handover anniversary. I wonder anyone signed the S&P 3 years ago which they entitled asking for compensation. I signed the S&P early year 2008. Nothing we can do except waiting. I just hope that I can move in before Aug 2009.
